How we can help to protect the best interests of the child

Virginia courts evaluate the amount of child support to be paid by the non-custodial parent on the basis of that parent's income and on the basis of what the child needs. Thus, child support payments, which are often paid monthly, help to support the basic needs of the minor child, including paying for food and clothing. In some cases, the child may even have some special needs for necessary medical treatment. The court will look into all of those factors before making a final decision about the child support amount.

If the non-custodial parent defaults on the necessary child support payments as a pattern, the child and the custodial parent can experience major financial challenges. In many cases, defaulting non-custodial parents often do not pay child support for a prolonged period. Because of that experience, custodial parents sometimes feel the need to consult an attorney in such a case in order to force the non-custodial parent to pay child support.

The attorneys at Jeffrey A. Vogelman and Associates have helped many custodial parents recover child support payments or seek modifications of child support. Often, experienced attorneys can help the custodial parent to recover the child support payments by sending the non-custodial parent's employer an order requiring the employer to withhold the non-custodial parent's wages.

In many cases, the authorities have the power to initiate a proceeding against the defaulting, non-custodial parent. Furthermore, in a case in which there are repeat incidents of default on child support payments or where the non-custodial parent willfully and wrongfully fails to pay child support, criminal charges may also be brought by the state. However, sometimes a custodial parent's best option is to go through a private attorney.
